Introduction

By virtue of the powers conferred by Law N°491-06 on Civil Aviation of the Dominican Republic and its reforms, the Dominican Institute of Civil Aviation (IDAC) has submitted for public consultation a series of Development or Amendment Proposals (PDE) to the Dominican Aeronautical Regulations (RAD), through its SIAGA system[1], among other means. These include: RAD 20 Administrative Sanctions (version 3.0), Meteorological Service for International Air Navigation (version 5.0), and RAD 11 Air Transit Services (version 9.0).

As indicated, these initiatives respond both to the need for technical updating derived from the amendments issued by the International Civil Aviation Organization (ICAO), and to internal reforms motivated by national legislative modifications, including Law N°17-24, which introduces substantive changes to the aeronautical legal regime. Also as part of the system adopted by the Open Skies Agreement with the United States.

The analysis of the elaboration procedure of these regulatory projects, as well as their substantive content, reveals a clear intention to adjust the procedure for their enactment, as well as for the sanctioning administrative procedure, to the principles and guarantees established in Law N°107-13 on the Rights of Persons in their Relations with the Public Administration and Administrative Procedure.

II. Applicable regulatory framework

Consistent with the Dominican Constitution, Law N°107-2013 constitutes the general legal regime that regulates the actions of the Public Administration in the Dominican Republic, both for the enactment of regulations such as the RAD, and for the exercise of the sanctioning power and application of the sanctioning administrative procedure, to which we will refer briefly on this occasion. Consequently, it establishes guiding principles of transversal application, such as legality, transparency, participation, motivation, good administration, simplification and responsibility, which are fully enforceable in the administrative sanctioning procedures under the responsibility of IDAC, in accordance with Law N°491-2006 and modified or expanded by Law N°17-24. Therefore, all normative actions of the governing body of civil aviation must observe these principles, even in the specialized technical field.

III. Critical analysis of the RAD projects

1.Citizen participation and right to a hearing
Regarding the procedure to guarantee citizen participation, article 31.3 of Law N°107-2013, provides that: “Hearing of citizens directly affected in their rights and interests. The hearing of citizens, directly or through the associations that represent them, must take place in any case before the final approval of the regulatory text, plan or program when they may be affected in their legitimate rights and interests. A reasonable and sufficient period must be granted, depending on the subject matter and the concurring circumstances, so that this hearing is real and effective. The Administration must also have a reasonable and sufficient period to process and analyze the allegations made”. The draft regulations are published on the SIAGA portal for public consultation for a period of thirty (30) calendar days.

However, it does not indicate whether a formal hearing procedure is contemplated, nor does it guarantee the weighting of the proposals received for their eventual inclusion. Law N°107-2013, in its articles 3 and 15, recognizes the right of individuals to actively participate in the administrative procedures that affect them, which requires more robust mechanisms than mere digital publication. Participation implies institutional activism, and its design must include channels that allow the intervention of specialized sectors, such as academia, in addition to technical associations and legal operators. It is important that calls for this medium indicate the entire program contemplated to guarantee full citizen participation in these processes, including the hearing.

Even, from a regulation that we usually take as a reference in aviation matters, such as the American one, it contemplates the public hearing when a person requests it. In this sense, the CFR (Code of Federal Regulations), in 14 CFR § 11.39[2], establishes that any person can participate in the process of developing rules, such as those of the FAA through: written comments on any regulatory document, request for public meetings and petitions to create, modify or eliminate regulations.

This may be a procedure already contemplated. However, when it is sent without this information, it gives rise to questions and recommendations. It is therefore recommended that, in addition to contemplating it, a schedule of participation, face-to-face or virtual consultation sessions, and the systematization of the observations received, available and visible to all actors, be published by all means.

2.Motivation of normative acts
At the moment, the projects lack statements of reasons that explain the legal, technical and factual reasons that justify the adoption of the proposed modifications. This omission contravenes article 20 of Law N°107-2013, which requires the express motivation of all administrative action, including those of a normative nature. Although the style of the RAD does not allow for the inclusion of reasons, it could well be established as an annex.

3.Principle of good administration
Any call for modification of regulations must contain indicators of normative performance, ex post evaluation mechanisms and internal control protocols limits the effective application of the principle of good administration enshrined in article 4 of Law N°107-2013. Aeronautical regulations must incorporate tools that allow verifying their impact on operational safety, regulatory efficiency and the protection of rights, regardless of the international supervision mechanisms that may exist in parallel to the content of the regulations. It is worth saying that it must be conceived in an integral way.

4.Access to information and active publicity
Although the drafts are available online, it is important that complementary information such as technical studies, previous versions of the RAD and regulatory impact reports are also published. Their absence restricts the right of access to administrative information provided for in article 5 of Law N°107-2013 and limits critical analysis by the technical and legal community.

IV. Administrative simplification
Some projects, such as RAD 20 on administrative sanctioning procedure, maintain confusing procedural structures that deviate from standardization by varying procedures contemplated in the Law N°107-2013. Article 6 requires that the procedures be clear, agile and not redundant, which requires a substantive review of the legislative technique used. It is desirable, for example, that, consistent with the provisions of articles 22 to 29 of Law N°107-2013 in each of the investigative and sanctioning stages, each of the actions of the administrative sanctioning procedure are clearly indicated, including the guarantees of defense of persons when they are subject to an administrative sanctioning procedure. It is the case, for example, that on the one hand it indicates that other units (Directorate of Flight Standards and Directorate of Surveillance of Air Navigation Services and Aerodromes) may carry out instruction actions, but it does not indicate in which circumstances this would occur. It should be clarified when the different phases of instruction would be exercised. Similarly, the administrative unit other than these that would recommend the applicable sanctions should be indicated.

In this same measure, it is important that the terms contemplated in the regulation for the instruction, investigation and application of administrative sanctions are adjusted and do not contravene the provisions of the laws and comply with the principles of celerity. Any term that contravenes Law N°491-2006 and Law N°107-2013 would make the regulation voidable in this part.

V. Administrative responsibility
The RAD projects lack specific provisions on the responsibility of public officials in the application of technical regulations. Article 23 of Law N°107-2013 establishes personal responsibility for arbitrary, negligent or contrary acts to the legal system, which must be reflected in the sanctioning regime and in the control protocols.

VI. Ex post regulatory analysis and impact

Similarly, in addition to all the aspects that must be contemplated during the procedure for the elaboration of the regulations, an ex post analysis of the regulatory impact of the norm must be weighed and planned from now on, from which needs for modifications, corrections and new regulations are revealed, in accordance with the provisions of Law N°167-2021.

The initiative to review and update the Dominican Aeronautical Regulations (RAD) represents a significant step towards the consolidation of a modern, transparent regulatory framework aligned with international standards. The opening of the process to public consultation, through platforms such as SIAGA, reflects an institutional commitment to citizen participation, continuous improvement and the construction of a safer, more efficient and democratic civil aviation.

These normative proposals not only respond to technical and legal requirements, but also demonstrate a willingness to adapt to the new challenges of the sector, in accordance with the principles of good administration and respect for fundamental rights. In this sense, the process initiated by the Dominican Institute of Civil Aviation (IDAC) should be valued as an opportunity to strengthen institutionality, promote technical and legal dialogue, and advance towards a more robust and legitimate aeronautical regulation.

We trust that this normative effort will contribute to raising the standards of operational safety, regulatory efficiency and protection of rights, consolidating the Dominican Republic as a regional benchmark in civil aviation.

[1] Technological platform used to deposit electronic flight plans by pilots and airlines, facilitate compliance with national and international aeronautical standards (such as those of ICAO), and Optimize operational safety and the provision of air navigation services.

[2] 11.39 How may I participate in FAA’s rulemaking process?

You may participate in FAA’s rulemaking process by doing any of the following:

(a) File written comments on any rulemaking document that asks for comments, including an ANPRM, NPRM, SNPRM, a final rule with request for comments, or a direct final rule.
